Whose responsibility is health and safety in the workplace ? employer or employee?

Personal injury claims adverts make it clear that employers are expected to provide safe working environments. This is to ensure not only that their employees are able to work safely, but also that visitors to the place of work ? whether they are contractors, customers or anyone else ? are also not at unreasonable risk of injury.

While any reasonable employer would want to make sure they were providing this kind of environment anyway to attract the best possible staff and avoid scaring off customers, the Health and Safety Act was passed 1974 to make it compulsory. While injuries inevitably still happen, our workplaces are safer than they were before the Act was implemented.

However, this is not to say that an employee isn?t also responsible for health and safety at work. If an employee is given adequate training and equipment so that he or she can do a job safely it is up to the employee to make sure they implement what they have learned and use the equipment properly. The employee must also take reasonable measures to make sure their actions are not putting anyone else in danger.

It?s vital that employees are aware of their responsibilities not only for their own safety, but also so they don?t put other people at risk. This is why it?s important that you don?t leave items cluttering up corridors, which could prevent emergency procedures from running smoothly or cause someone to trip over. You should also make your employer aware of any changes to the work environment or your personal circumstances that could throw up new hazards (becoming pregnant or taking certain medication for example).

With the number of personal injury claims lawyers in business it?s clear that employers are often failing to meet their responsibilities as far as health and safety in the workplace is concerned. However, it?s just as important that employees are aware of their responsibilities, for their own wellbeing and the wellbeing of other colleagues and members of the public.

Forklift accidents always tend to happen due to the injured person?s fault and rarely the drivers fault.
